These Terms and Conditions (“Agreement”) govern the use of services provided by Tekzop LLC (“We,” “Us,” “Our”) to clients (“You,” “Client,” “Your”). By engaging with our services, you agree to comply with and be bound by these terms.
1. Services Provided
Tekzop LLC offers lead generation services for real estate professionals, including but not limited to:
- Qualified appointments or live transfers with prospects interested in selling their properties.
- Marketing and lead generation services as per the client’s requirements.
- Other related services as described in the client agreement.
2. Agreement Term
- The minimum commitment term for services is one month from the date of the initial service agreement. Services will be automatically renewed unless either party gives written notice of cancellation as per the policy.
3. Payment Terms
- All services are billed as per the terms outlined in the service agreement.
- Payment Methods: Payments can be made via credit card, ACH, or wire transfer.
- Late Fees: A late fee of $145 will apply to invoices that are not paid within three days of the due date.
- Credit Card Authorization: Clients who choose to pay by credit card authorize Tekzop LLC to charge their card for the agreed monthly service fee until the contract is terminated.
- ACH and Wire Transfers: Clients who pay via ACH or wire transfers must ensure timely payments, and the client agrees to manually process payments for each month in line with the agreed terms.
4. Refunds and Cancellations
- Refund Eligibility: Clients can request a full refund if Tekzop LLC fails to deliver the promised number of booked appointments or live transfers during the first month. The prospect must meet the qualified lead criteria outlined in the Refund Policy section.
- Cancellation: Either party can cancel the service agreement with written notice after the minimum service period of one month. Cancellation will take effect at the end of the current billing cycle.
5. Qualified Leads
- To be classified as a qualified lead, the prospect must meet the following criteria:
- Intends to sell a property.
- Has authority to sell the property.
- Is not already under contract with another realtor.
- Can provide accurate property details (condition, selling price, etc.).
- Has no existing financial or legal constraints (e.g., loans, liens).
6. Client Responsibilities
- Clients are responsible for providing accurate information related to their services and leads.
- Clients must ensure the accuracy and validity of the leads they are pursuing.
- Clients agree to cooperate with Tekzop LLC to maximize lead conversion and ensure the successful delivery of services.
7. Confidentiality
- Both parties agree to keep all information, whether business or personal, confidential.
- No information shall be disclosed to third parties without prior written consent unless required by law.
8. Intellectual Property
- All intellectual property (IP) used or created during the service period remains the property of Tekzop LLC. Clients may not use or distribute the IP without express permission.
9. Limitation of Liability
- Tekzop LLC shall not be held liable for any damages arising from the use of our services beyond the total amount paid by the client for the services during the preceding 12-month period.
10. Termination of Services
- Tekzop LLC reserves the right to suspend or terminate services if the client fails to comply with the payment terms, provides false information, or acts in a manner that disrupts the delivery of services.
- Either party may terminate the agreement at any time, but termination will be subject to the agreed payment terms and conditions.
11. Dispute Resolution
- In the event of a dispute, both parties agree to attempt to resolve the issue amicably through negotiation. If negotiation fails, disputes shall be resolved in the courts of Illinois, governed by the laws of Illinois.
12. Amendments to Terms
- Tekzop LLC reserves the right to modify these terms and conditions at any time. Clients will be notified of any changes, and continued use of services will be considered as acceptance of the updated terms.
13. Entire Agreement
- This Agreement represents the entire understanding between Tekzop LLC and the Client and supersedes all prior communications, agreements, and understandings, whether oral or written.
